What is the Lemon Law?

The Lemon Law, also sometimes referred to as the Song-Beverly Consumer Warranty Act, is a law designed to protect consumers who unknowingly purchase a defective vehicle, often referred to as a “lemon.” This law applies to vehicles that are sold or leased with a manufacturer’s warranty. If a vehicle experiences persistent issues that substantially impairs its use, value, or safety, and these problems cannot be fixed after a reasonable number of repair attempts by the manufacturer or its authorized dealers, the consumer may be entitled to a replacement vehicle or a refund of the purchase price. The Lemon Law aims to provide consumers with recourse when they find themselves stuck with a faulty vehicle.

What To Do If You Think You Have a Lemon?

  1. Take Your Vehicle to the Dealer for Repair: If you’re having issues with your vehicle, it is very important to take it in to the dealer or manufacturer for repairs as soon as possible. This ensures that the manufacturer has the opportunity to fix any problems before Lemon Law rights can be exercised.
  2. Report all Your Concerns: When you take the vehicle to the dealership, let the dealership personnel know about all of your concerns and make sure the dealer accurately documents each and every complaint. When you pick up your vehicle, make sure that each of your complaints were addressed. The final repair record you receive should include a description of what the dealership did, or did not do, to address each complaint.
  3. Give the Dealer a “reasonable Number of Attempts” to Resolve the Issue: When determining what constitutes a “reasonable number of attempts,” it is important to consider various factors such as the severity of the defect, dealership findings, and the number of times presented to the dealership for the same or similar issue. While there is no set number, typically two to four visits are needed, though successful claims can sometimes be made on the first visit if the dealership time exceeds 30 days. Given the subjective nature of this standard and that case is unique in their set of facts, consulting with a California lemon lawyer is advisable for clarity and guidance.
  4. Keep and Maintain all Records: Always keep and maintain the repair records and receipts.
  5. Document all Issues: If you are able to, document the issues exhibited by the vehicle (i.e. photographs, video, etc.)
